Welcome to Globetrotters.ai. These Terms of Use (“Terms”) govern your access to and use of the Globetrotters.ai website, dashboard, APIs, and services (collectively, the “Service”). The Service is intended for business customers — destinations, accommodations, attractions, and their partners — and the authorized representatives who use the Service on their behalf (“Customer”, “you”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Globetrotters.ai is currently operated as an independent project. These Terms will be updated upon the formal registration of Globetrotters.ai as a legal entity.

1. Eligibility

To use the Service, you must be at least 18 years old and authorized to enter into a binding agreement on behalf of the organization you represent. By using the Service, you represent that you meet these requirements.

2. Customer Accounts

• Access to the Service requires a Customer account. Accounts are created for and used by authorized representatives of our business customers.
• You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
• You agree to provide accurate, current, and complete information when creating and maintaining your account, and to notify us promptly of any unauthorized use.

3. Use of the Service

• You agree to use the Service only for lawful business purposes and in compliance with these Terms and applicable laws.
• You must not:
  • Submit false, misleading, or unlawful content to the Service.
  • Use the Service to harass, defame, or violate the rights of others.
  • Scrape, reverse-engineer, decompile, or otherwise attempt to extract the source code or underlying models of the Service.
  • Use the Service or its outputs to train, fine-tune, or evaluate competing products or models.
  • Circumvent any access controls, rate limits, or security measures.

4. Customer Data

• Ownership: You retain all rights, title, and interest in the data, content, and materials you submit to the Service (“Customer Data”), including information about your destination, properties, attractions, inventory, and brand.
• License to us: You grant Globetrotters.ai a non-exclusive, worldwide, royalty-free license to host, copy, transmit, and process Customer Data solely to provide, secure, and improve the Service for you, and to comply with legal obligations.
• Your responsibility: You represent that you have all rights necessary to submit the Customer Data to the Service and that the Customer Data does not infringe any third-party rights or applicable laws.
• Aggregated insights: We may generate aggregated and de-identified statistics from Service usage. Such aggregated data does not identify you or your end-users and may be used to operate and improve the Service.

5. Intellectual Property

• All trademarks, logos, software, models, and other intellectual property of the Service are owned by Globetrotters.ai or its licensors.
• Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription term.

6. Privacy

Our Privacy Policy explains how we collect, use, and protect personal data. By using the Service, you acknowledge the practices described there. View our Privacy Policy at /privacy.

7. Subscriptions and Fees

• Access to the Service is generally provided under a subscription plan. You agree to pay all fees applicable to your subscription, as set out in your order or on our pricing page.
• Fees are exclusive of taxes, which are your responsibility where applicable.
• We may change pricing or subscription terms with reasonable prior notice; changes take effect at the start of your next renewal term unless otherwise stated.
• Except where required by law, fees are non-refundable.

8. Third-Party Links and Services

The Service may contain links to, or interoperate with, third-party websites, APIs, or services (including travel platforms, search engines, and large language model providers). We are not responsible for the content, availability, or practices of those third parties, and your use of them is subject to their own terms.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, in the event of a material breach of these Terms, non-payment, security risk, or as required by law. You may terminate your subscription in accordance with your order. Upon termination, your right to access the Service ends; sections that by their nature should survive will remain in effect.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We make no warranties or representations, express or implied, regarding the accuracy, reliability, completeness, or availability of the Service or any outputs. The Service relies in part on third-party models and data sources whose behavior may evolve over time.

11. Limitation of Liability

To the fullest extent permitted by law, Globetrotters.ai and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless Globetrotters.ai and its affiliates from any third-party claims, damages, or expenses arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect signifies your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising out of or in connection with these Terms or the use of the Service will be subject to the exclusive jurisdiction of the courts of Nantes, France.
